Official Rules and Regulations

1. How to enter:

Entries will be accepted at the Niagara Folk Arts Festival “Days in the Park” Located at Montebello Park, St.Catharines, ON. Entrants may submit their artwork to the contest booth, between 11am and 8pm on Saturday May 28th, 2011 and 11am to 1:00pm on Sunday May 29th, 2011 Colouring pages for contestants in grades JK, K, Grades1 & 2 may be downloaded from www.folk-arts.ca

Entrants in grades 3 through 12 must draw “Your Multicultural Community”. Entries must be submitted on white paper no larger than 8 1/2” by 11”.

All entrants may only use markers, crayons or pencil crayons.

Each individual may only submit one entry. In order for an entry to be valid, a form must be filled out at the contest booth by the entrant. Each entry will be automatically entered to win the grand prize and the 1st prize in their category. Any entry found to be inappropriate will be disqualified at the discretion of the Niagara Folk Arts Festival Producers.

2. Eligibility:

Contest is open to all Niagara Folk Arts Festival attendees in grades Junior Kindergarten, Kindergarten and grades 1-12. Void where prohibited by law.

3. Contest Prizes:

One (1) Grand Prize winner will receive a $75.00 the Pen Center gift certificate.                         
Each 1st Prize Winner will receive a $30.00 the Pen Center gift certificate.
Categories:
a) JK, Kindergarten, Grade 1 and Grade 2
b) Grade 3, Grade 4, Grade 5
c) Grade 6, Grade 7, Grade 8
d) Grade 9, Grade 10, Grade 11, Grade 12

The 1st place and grand prize winners will be selected by a panel of judges, to be determined by the Niagara Folk Arts Festival.

The winners will be announced at the Niagara Folk Arts Festival on Sunday May 29th, 2011 around 3pm.

No cash or other substitution, assignment or transfer of prizes permitted except by the sponsor, which reserves the right to substitute a prize or prize component with another of comparable or greater value.

Winner may forfeit prize if Niagara Folk Arts Festival is unable to contact him or her within seven (7) days of first attempted notification. Winner must meet the eligibility requirements for the Contest as described above. The Niagara Folk Arts Festival will determine whether the winner meets those requirements only for those winners who have responded to the Selection Notification within the time allowed. The winners are not required to attend the winning announcement.

Winners who do not meet the eligibility and other requirements for the Contest will be disqualified and an alternate winner may be selected. Entrants agree to be bound by the terms of these official rules and by the decisions of the Niagara Folk Arts Festival, which are final and binding on all matters pertaining to this Contest. Failure to comply with this deadline may result in forfeiture of the prize. No prize substitutions will be permitted, except the Sponsor may substitute any prize with one of equal or greater retail value. Prizes are not transferable or redeemable for cash.

6. Entrant's Personal Information: Personal information will only be used to contact entrants at the completion of the contest. Entrant's personally identifiable information will not be shared with any other third parties.

7. Publicity:

All entry materials (including Entries) become the property of the Niagara Folk Arts Festival and will not be acknowledged or returned. Entry into this Contest constitutes entrant's irrevocable and perpetual permission and consent, without further compensation or attribution, for the Contest

Entities, to use, reproduce, modify, create derivative works from, print, publish, transmit, distribute, sell, perform, adapt, enhance, and display such Entry for any purpose, including, but not limited to, editorial, advertising, trade, commercial, and publicity purposes by the Niagara Folk Arts Festival, and/or others authorized by the Niagara Folk Arts Festival, in any and all media now in existence or hereinafter created, throughout the world, for the duration of the copyright in the Entry. The Niagara Folk Arts Festival, and/or others authorized by Niagara Folk Arts Festival shall have the right to edit, adapt and modify the Entry. Subject to applicable law, winner irrevocably grants Niagara Folk Arts Festival and its licensees, and its and their successors, assigns and sublicenses the right and permission to use their name, voice, likeness and/or biographical material for advertising, promotional and/or publicity purposes in connection with the Contest, in all forms of media and by all manners (now and hereafter known), and on and in connection with related products, services, advertising and promotional materials (now known or hereafter developed), worldwide, in perpetuity, without any obligation, notice or consideration except for the awarding of the prize to the winner. Entrants agree not to issue any publicity concerning the Niagara Folk Arts Festival.

8. General Conditions: The Niagara Folk Arts Festival reserves the right to cancel or modify the Contest if fraud, technical failures or any other factor beyond Niagara Folk Arts Festival's reasonable control impairs the integrity of the Contest, as determined by the Niagara Folk Arts Festival in their sole discretion. In such event, Niagara Folk Arts Festival reserve the right to award the prizes at random from among the eligible entries received up to the time of the impairment. The Niagara Folk Arts Festival reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules. Any attempt by any person to deliberately damage any web site or undermine the legitimate operation of the Contest is a violation of criminal and civil law, and should such an attempt be made, the Niagara Folk Arts Festival reserves the right to seek damages from any such person to the fullest extent permitted by law. The Niagara Folk Arts Festival's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

9. Limitations of Liability:
By accepting prize, winner agrees to hold Niagara Folk Arts Festival, their directors, officers, employees and assigns harmless for any injury or damage caused or claimed to be caused by participation in the Contest or acceptance of the prize. The Niagara Folk Arts Festival is not responsible for any typographical or other error in the printing of the offer, administration of the Contest or in the announcement of the prize. In no event shall the Niagara Folk Arts Festival, their affiliates and related companies, or their respective officers, directors, employees, or agents collectively herein, parties by liable for:

(i) technical failures of any kind, including, but not limited to, the malfunctioning of any
computer, cable, network, hardware or software
(ii) the unavailability or inaccessibility of any transmissions or telephone or internet service;
(iii) unauthorized human intervention in any part of the entry process or the Contest;
(iv) electronic or human error which may occur in the administration of the Contest or the processing of entries;
(v) any injury, loss, claim, damage, or special, punitive, indirect, incidental or consequential damages or any kind (including, but not limited to lost profits or lost savings), whether based in contract, tort, strict liability or otherwise, to persons or property, including, but not limited to, entrant's computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Contest or that arise out of or are in any way connected with the use, or the inability to use, the www.folk-arts.ca website or the services or materials on the site, even if advised on the possibility of such damages. In no event shall the aggregate liability of the parties exceed the total charges set forth in the itinerary giving rise to such liability. Applicable law may not allow the limitation of exclusion of liability of incidental or consequential damages so the above limitation or exclusion may not apply to you. Your use of the site shall be at your own risk.

10. Disputes:
Limitations of Liability. By entering the contest, entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, or any prizes awarded, shall be resolved individually without resort to any form of class action, and entrant waives his or her right to a jury trial for such disputes, claims, and causes of action; (2) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.
